Terms of Use
These are Memboro’s terms of use, and they apply to all users of the Memboro platform. “We,” “our” or “us” refers to Memboro. “Memboro” refers to this platform and the services offered by us.
By accessing this platform, you are agreeing to be bound by these terms of use and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this platform are protected by applicable copyright and trademark law.
Are you a creator?
If you believe you have something informative or entertaining to share with the world, Memboro welcomes you to join as a creator! We stand by the motto “Your passion doesn’t have to be just a hobby anymore” and if this aligns with your goals, and you wish to financially support the work you put your valuable efforts and time in, sign up as a creator right away! Anyone who signs up on the platform as a creator would be considered as a creator irrespective of what content they post.
Memborship
Memborships are monthly payments automatically done by the user through their credit card. The span of membership is 12 cycles, after which the user can repurchase the membership. We encourage creators to use membership features to provide multiple and unique benefits to have the excitement running in their fans. This way they can keep receiving the support for a longer duration. It is advisable for creators to communicate with their fans and always provide the perks listed in membership. In certain cases, when the creator is unavailable, they should communicate the same with their fans.
Payments for Memborships
The memberships are based on a subscription model. The payments, frauds and chargebacks along with disputes on payments are handled by Memboro, and we store no card information. We provide accurate information about your funds and payments received and make payouts in a timely manner after you have completed your payout details, but one may experience delays at rare moments. In case of violation of policies or for certain compliance reasons the payments might get blocked. The same will be communicated through Memboro with an appropriate reason. One has to remember that at times the account funds might turn negative and in those scenarios, Memboro holds the right to recover those payments from future payouts.
Deletion of Memborships
Creator reserves the right to delete memberships as per their need, in this scenario the payments would be cancelled for the fan at the end of the given cycle. The payout will be done once the memberships are settled for this kind of model for all the fans availing the membership.
Platform Fee for Memborships
Memboro currently works on platform fee which is availed from the transaction done by the fan for a particular memborship. We charge a flat fee of 7% (platform fee) + 3% (transaction fee) for each transaction done on the platform. Platform fees, is the fee collected by Memboro for smooth working of the platform and memboro holds the right to change these fees as per the business requirement. Transaction fee is directly collected by the payment partner on each transaction. We have no control over these fees and are typically 3.0%. In case of change in these fees, Memboro will give direct benefits of such a change to our creators.
Example of a transaction:
- Memborship model: Rs. 500/Month
- Platform fees: Rs. 35
- Transaction fees: Rs 15
- Payout amount: Rs. 450
Commissions
A creator on Memboro can also offer commissions, which can be defined as but not limited to, selling their artwork, private or custom projects, offering workshops, skill development sessions, online/offline show tickets, etc. These are subject to the creator's creativity and how he wishes to use this feature. The service being offered by creators should be their own and Memboro holds the right to delete commissions that are not part of our guidelines.
Payments for Commissions
The payment amount can be specified by the creator for each commission they create with details required from the user’s end point. The payment will be collected by Memboro and would be part of the monthly payout. After commission is marked completed by the creator and no objection is raised by the user in the first 7 days of completion the amount would be added to payouts. In case of dispute between the fan and the creator (to be raised via email at [email protected] with Subject titled - [Commission Dispute "commission ID"], Memboro will hold the payment till the dispute is resolved. The same will be communicated from Memboro when that payment is being held. Memboro will coordinate with the creator and help resolve the issue. Cancellation of Commissions
The creator holds the right to cancel any commission at any point of the time and the same should be conveyed to the user. In case of cancellation from the creators end, the fee will be deducted from the creators payout. One has to remember that at times the account funds might turn negative and in those scenarios, Memboro holds the right to recover those payments from future payouts. The refund will be initiated to the user for the full amount in this case. If the user cancels the subscription in between then no refund would be provided to the user.
Tax
Memboro currently does not provide any help to the creator for filing their taxes, though we wish to extend this aid in future. The company pays all the taxes as required by the Law of India.
Are you a Membor?
Anyone who signs up on the platform as a fan is a membor on memboro. Membor signifies a person who wishes to support any creator, or multiple creators. Anyone who subscribes to a creator memborship, chooses to give a single payment to a creator using ‘cheer jar’ or place a commission order with a creator would also be treated as a membor on memboro.
General Guidelines
It is the sole responsibility of membor, who they follow and what content they follow. There are some guidelines that the Membor should follow in order to be a part of the Memboro family. A summary of those rules is that we don’t allow:
- Membors should not share the content of the platform to any third party platform.
- Membors should not publish the content of the creator without their permissions.
Memborships
Membors can support their favorite creators by subscribing to their monthly memborships. The perks and services for each memborship model is defined by the creator and are subject to change as per their will. It is to be noted that a creator cannot change the amount charged for a subscription mid cycle, they can only delete the current model and make new models which can be subscribed by the membors. The same shall be communicated to the membors by the creator. The payments in such a case will stop at the end of the current cycle which will be taken care of by Memboro. A Membor reserves the right to cancel the subscription at any point of time through the Membor dashboard; the subscription will be cancelled immediately and the content for those subscriptions will be marked locked for them. Membors must note that the payment for the cycle will be charged in full amount and no refund will be made in such a scenario. We attempt to screen for fraudulent creator pages, but cannot guarantee the identity of creators or the validity of any claims they make.
Commissions
A membor can buy commissions offered by the creator on their profile page, these are private works that are offered as a service by the creator. We expect membors to read the terms and conditions of each commission before they make the payment and also provide complete details for the communication or other details as requested by the creator.
Cancellation of commission
Commissions can be cancelled by the user from their end before it is marked approved by the creator; full refund will be initiated in such a scenario with minor deduction because of transaction fee. In case of cancellation by the user after commission is marked approved, the refund will be initiated for half the value. Membors reserve the right to raise an issue with Memboro if their commission hasn’t been approved and marked work in progress, with the subject titled - [Commission Dispute "commission ID"] | "creator name" in email.
Other General Terms
Cheer Jar
Cheer jar is a one time payment portal where membors and non-membors can show their support to a creator. They can send in a small message along with their name to the cheer jar. The user agrees with the cheer jar to show their message and name to the public via the cheer wall. The reason for having a cheer jar is to build a positive community and not spread hatred. We expect everyone to be encouraging with their messages. In case of hateful comments, the creator reserves the right to remove such messages from the cheer wall. Messages will be displayed on the wall only after the approval is made by the creator.
Cheer Wall
Cheer wall is a wall full of love and messages of support from membors and non-membors. It is directly associated with the Cheer Jar. It will be the creator's decision to approve a particular message and only then it would be displayed on the wall.
